Terms Of Use

The information and content provided in these pages is not legal advice, and should not be relied on as such. All content on the pages on this website are for informational purposes only, and is meant as a starting point on your search for answers to your legal questions. The law is constantly changing and evolving. We cannot guarantee that all information contained in this website is up to date at all times. Therefore, we recommend that you contact an experienced attorney in your area to guide you through your legal matter.

When you speak with our attorneys and staff, everything you tell us about your case is confidential. However, we do not represent you (in court or otherwise) unless and until a fee agreement is signed by both you and us, and a retainer is received.

Nothing in this website should be taken to create an attorney-client relationship.

CONSULTATIONS: We may offer any person a no-obligation initial consultation. This in no way obligates us to represent you, or to answer any specific questions. We reserve the right to deny a consultation to anybody, for any reason.

    • Our first meeting is an initial consultation only. It does not establish an attorney-client relationship between you and Volpe Law, LLC. Any and all communications are subject to confidentiality rules, conflict of interest rules, and the attorney-client privilege, to the extent allowed by law, whether or not any attorney-client relationship is formed now or in the future. Filling out any website form or questionnaire and meeting with the firm for an initial consultation does not bind this firm in any way to provide further work or legal services for you. Should this firm undertake your representation, our arrangement must be formalized in writing and consideration must be paid for our services beyond the cost of the initial consultation. Rates and scope of representation will be discussed with you in detail prior to signing any engagement or retainer agreement.
    • You understand that Volpe Law, LLC is only providing you with initial observations concerning the matter discussed and possible approaches to your case. This applies even if you share documents for our review. You understand that this cursory review does not give Volpe Law, LLC enough information to advise you of all problems or potential liabilities that the document or situation may present, and that we would only provide you with a full analysis of the situation after you have signed a written fee agreement with Volpe Law, LLC to do so, and you have paid the initial retainer.
    • Your matter may be subject to time limitations. You may be barred from taking any action if you do not timely act. You are not relying on Volpe Law, LLC to take any action to represent you or preserve any claim that you may have or may assert. You alone are responsible to act in a timely manner to preserve any legal claims or defenses. We will attempt to contact you in a timely manner after this form is submitted to the extent possible and at firm’s sole discretion; however, you understand that we have a very high call and contact form volume and cannot contact everyone who submits this form. If you do not hear from us within 24 hours, you should continue your search for a law firm.
    • You are not a prospective client until you have a consultation with a lawyer at this firm. Merely filling out a website contact form or questionnaire does not constitute a “consultation.” According to the Colorado rules of professional conduct, “a consultation does not occur if a person provides information to a lawyer in response to advertising that merely describes the lawyer’s education, experience, areas of practice, and contact information, or provides legal information of general interest [such as the www.volpelawllc.com website].” “Such a person communicates information unilaterally to a lawyer, without any reasonable expectation that the lawyer is willing to discuss the possibility of forming a client-lawyer relationship, and is thus not a “prospective client.” Moreover, a person who communicates with a lawyer for the purpose of disqualifying the lawyer is not a “prospective client.” Colo. R.P.C. 1.18 cmt [2].
    • You give informed consent to this law firm that no information disclosed on forms or questionnaires on this website or in any consultation with the firm will prohibit this law firm from representing a different client in any matter which you are involved in. In other words, you understand and agree there is a chance, however slight, that we already represent a client that is opposed to your position. You submit information via this website, and provide information in your initial consultation, should a consultation occur, with the understanding that we are asking for limited information about your case so we can ascertain whether we can help you and whether we have a potential conflict of interest. Providing information on forms or questionnaires on this website or discussing your case with us in an initial consultation could mean that we learn something that helps a current client of this firm who is opposed to your position. This could result in damage to your position and/or increased costs of representation to you. You have options and the right to choice of counsel. You are not obligated to provide information to, or enter into a relationship with, Volpe Law, LLC. You understand and consent that any information provided by you could be used against you and are willing to bear that risk in submitting this form and speaking with our firm. See Colo. R.P.C. 1.18 cmt [5]. The basic rules of professional conduct cited in this agreement apply to all licensed attorneys in Colorado. Some law firms may choose to avoid allowing the general public to submit information to the firm via website contact forms in fear of obtaining information that could cause a potential conflict of interest. We think our website contact forms provide a simple and effective way for the general public to summarize legal issues and potentially obtain legal services. Therefore, we hope in summarizing these rules of professional conduct and seeking your informed consent to continue, that you are armed to make the best decisions possible with respect to interviewing and selecting a law firm.
